Terms of Service

• You must be at least 18 years old to use the Service, with or without an account. The Service is not directed to, and may not be used by, anyone under 18.
• The Service is not offered in the European Economic Area, the United Kingdom or Switzerland, and you may not create an account or generate content from those regions.
• If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.

• Provide accurate information and keep it current.
• Keep your password secure and do not share your account.
• You are responsible for activity under your account.
• Tell us promptly at [email protected] if you suspect unauthorized access.

Centuriation uses third-party AI models (currently Google Gemini) to generate educational games and related content from topics, documents and designs you provide. We may modify, suspend or discontinue features at any time.

You agree not to use the Service to submit, generate, publish or share content that:

• infringes anyone’s copyright, trademark or other rights, or that you do not have the right to use;
• is defamatory, or makes claims about, targets or harasses a real private individual;
• is sexual, hateful, harassing, violent, promotes self-harm, or is otherwise unlawful;
• contains personal information about other people, or sensitive information about yourself that you do not want processed by AI providers.

You also agree not to:

• circumvent rate limits, quotas, region restrictions, safety filters or security measures;
• scrape, crawl or access the Service by automated means except through our published API under your API key;
• interfere with or disrupt the Service or its infrastructure, or attempt to break out of the sandbox that runs generated games;
• use AI-generated images for any purpose prohibited by the licenses of the models that created them, including to harm minors, to impersonate people, or to generate disinformation.

You keep ownership of the topics, text, files, game designs and other material you submit ("Your Content"). You grant Ferniotic LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process (including through our AI providers), adapt and display Your Content as needed to operate and improve the Service.

When you publish a game to the public gallery, create a share link, enable an embed, or appear on a leaderboard, you additionally grant us and other users the right to display, play and share that game and its associated title, description, topic and your first name and last initial, for as long as it remains published. You can unpublish or delete it at any time; copies already shared may take a reasonable time to be removed.

You represent that you have all rights needed to submit Your Content and that it complies with these Terms. We may review, refuse, remove or unpublish any content at our discretion.

Game content is generated by AI and may be inaccurate, incomplete, outdated or unsuitable. It is provided for educational entertainment only and is not professional, medical, legal or financial advice. We apply safety filters and validation, but cannot guarantee that every output is accurate or appropriate. Use your own judgment. As between you and us, and to the extent we hold any rights, you may use the content generated for you for personal and internal educational purposes.

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. See our Copyright Policy for how to send a notice or counter-notice. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

Paid plans are billed monthly in advance through Stripe and renew automatically every month at the then-current price until you cancel. Prices are shown on the pricing page and exclude any applicable sales tax, which is added at checkout where required.

You can cancel online at any time from the Billing page. Cancellation takes effect at the end of the current billing period, and you keep paid access until then. Except where required by law, we do not refund partial months. If you switch between paid plans, Stripe prorates the difference.

We will notify you before a price change takes effect, and the change will not apply to a billing period you have already paid for. If a payment fails, we may limit your account to the free plan until it is resolved.

Plan features are described on the pricing page. "Priority email support" on the Enterprise plan means we answer Enterprise support emails ahead of other plans; it is not a guaranteed response time. No plan includes a service-level agreement, uptime commitment or data processing agreement unless we sign one with you separately in writing.

The Service, including its software, game engines, artwork and design, is owned by Ferniotic LLC or its licensors and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or to the Service other than the right to use it as described here.

You can delete your account at any time from your profile or by contacting us. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections 5 (license for content already published, until removed), 6, 9, and 11–15 survive termination.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that AI-generated content will be accurate.

To the maximum extent permitted by law, Ferniotic LLC and its members, managers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill, arising from or related to the Service. Our total liability for any claim arising from or related to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.

You will defend, indemnify and hold harmless Ferniotic LLC from claims, damages and costs (including reasonable attorneys' fees) arising from Your Content or your violation of these Terms or of anyone's rights.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Massachusetts, and you and we consent to their personal jurisdiction. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

We may update these Terms. We will post the new version here with a new "Last updated" date and, for material changes, ask you to review and accept them before you continue using your account. Changes do not apply retroactively to disputes that arose before them.
